I-T Dept Conducts Searches at Software Firm Tulip

The Income Tax department today conducted searches at various premises of IT company Tulip Telecom for alleged evasion of taxes running into crores of rupee.

According to sources in the I-T department, searches are being conducted in at least six to seven premises in the national capital region by 40 officials.

A spokesperson of Tulip Telecom said he has "no official communication" on the incident and would not be able to comment.

Some survey operations related to the same firm were also conducted at Jammu two days ago.

Tulip Telecom is a data telecom service and IT solutions provider. According to the official website of the company, it has "revenues in excess of Rs 16,14.40 crore ($322 million) in the financial year ending 31st March 2009 and a market capitalisation in excess of Rs 2,131.50 crores ($426 million as on 31st March 2009)".

Tulip shares are listed on bourses. Its shares on BSE today closed at over Rs 954.90, a gain of over Rs 13 from its previous closing.

Tulip Telecom plans to launch value-added services, such as push mail and corporate internet services, for the corporate sector in a few months.

IT cos to pay tax on software purchases

BANGALORE: The Karnataka High Court has ruled that technology firms are subject to withholding tax - deduction of tax at source - when they purchase software from global vendors such as Microsoft. This would push tech firms and branded software distributors into a corner as they will be required to withhold anywhere between 10-20% of their software purchase payments in the future.

The division bench of Justice DV Shylendra Kumar and Justice Arvind Kumar pronounced the judgement on Thursday afternoon while upholding an appeal by the income tax department that tech firms were legally obliged to withhold tax on software purchases. The order is with retrospective effect.

The IT department argument was on the premise that any software purchase amounted to royalty payment for a licence to use it, and should not be deemed as a mere purchase of good that is excluded from withholding tax.

The order could impact branded software vendors such as Microsoft, their third party distributors like Sonata Software, hardware makers like Samsung and GE who bundles branded software with their products, tech firms like Infosys when they effect a licensing of software, or even the local arms of HP and IBM which could be licensing software from their parent.

This is the first court order that has gone against the taxpayer in Income Tax disputes relating to withholding tax on software purchase. In fact, the Karnataka High Court intervention came after the Income Tax Tribunal had ruled in favour of taxpayers prompting the department to go on appeal.

Oracle Q1 Revenues Decline, But Operating Profit Up 14%

Software license revenues decline, while software license updates and product support revenues rise

Oracle has reported a decline of 5% in total revenues to $5.1 billion in its first quarter of fiscal 2010 compared to $5.3 billion in the same quarter of the prior year. Software license revenues were down 17% to $1billion. Software license updates and product support revenues were up 6% to $3.1 billion.

For the quarter, operating profit was up 14% to $1.7 billion compared to $1.5 billion in the first quarter of 2008. The company's operating margin was up 590 basis points to 34% of revenues compared to 29% of revenues in the same period last year.

Oracle reported net profit of $1.1 billion compared to $1.07 billion in the same quarter of the prior year. Earnings per share were $0.22 up 8%, compared to the same period last year.

Safra Catz, president of Oracle, said: “By substantially improving operating margins we were able to increase Q1 earnings per share even though revenues decreased slightly. We grew non-GAAP operating margins by 570 basis points to 46% in our seasonally smallest quarter.”

Oracle Profit Rises 4 Pc in Q1, Revenues Drop 5.5 Pc

NEW YORK: Software major Oracle Corporation has reported a growth of four per cent in net income at USD 1.1 billion in the first quarter ended on August 31 this year, while it suffered a 5.5 per cent drop in revenues.

Total revenues decreased to USD 5.05 billion in first quarter 2010 fiscal from USD 5.33 billion in the same period last year, Oracle Corp said in a statement.

Analysts said the fall in revenues was due to companies slashing their expenditures and refraining from buying new softwares.

The software company's GAAP operating margins increased by 590 basis points to 34 per cent.

"By substantially improving operating margins, we were able to increase Q 1 earnings per share even though revenues decreased slightly," Oracle President Safra Catz said.

In addition, Oracle has declared a cash dividend of USD 0.05 per share of outstanding common stock to be paid to stockholders.

"Software licence updates and product support revenues grew 11 per cent to USD 3.1 billion for the quarter when adjusted for the change in the US dollar since last year,

"This growth, coupled with our disciplined expense management, was key to our ability to generate a record USD 8.5 billion in free cash flow over the last twelve months," Oracle Executive Vice President and CFO, Jeff Epstein said.

Google developing software to aid newspapers

Search engine giant Google is developing a technology that will help newspapers in charging money from online readers.

In a proposal to the Newspaper Association of America, Google said it is working on a software that would help newspapers to charge money from 'micro-payment', a payment vehicle which would be available both to Google and non-Google properties within the next year.

"While we believe that advertising will likely remain the same source of revenue for most news content, a paid model can serve as an importance source of additional revenue. In addition, a successful paid content model can enhance advertising opportunities, rather than replace them," the company said.

It said in a statement that it will mitigate the risk of non-payment by assigning credit limits based on past purchasing behaviour and having credit card instruments on file for those with higher credit limits and using proprietary risk engines to track abuse or fraud.

b) Mozilla Firefox 2.0 and higher.
c) Apple Safari 2.0 and higher.
9) The software must use the credit card Security Code for all transactions.

Software Budgets May Grow Faster Than Overall IT Spend

Business establishments in the Asia Pacific region are expected to spend the highest amount on new software in 2010, though they are expected to continue to be conservative with their IT budgets.

According to a recent survey by analyst firm Gartner, organisations in the Asia Pacific plan to increase their software budgets by 4.4 per cent on an average, while their overall IT budgets were expected to decline 3.1 per cent on an average. The average expected increase in the software budget by organisations in the Asia Pacific region is higher than all other regions surveyed, including Europe, West Asia and Africa, North America and Latin America, the research firm said.

Gartner surveyed 323 IT managers in Australia, Singapore, Malaysia, China, India and Hong Kong, as part of a worldwide survey of 982 respondents. Respondents were asked if they expected their 2010 IT budget to be below, the same or exceed their IT budget for 2009.

India-based respondents were the most optimistic, with the highest number of respondents intending to increase their IT budgets in 2010 (42 per cent), followed by China (32 per cent). However, Malaysia-based respondents remain pessimistic, with the largest number of respondents intending to cut their spend (52 per cent).

“For most organisations, the budgeting process happens once a year, but adjusting the IT budget is a continuous exercise driven by economic conditions and changes in the business,” said Gartner research director Yanna Dharmasthira.

“In the midst of economic volatility, hardware budget allocation remains the top priority in most countries, but software budgets are a real bright spot and continue to demonstrate a positive outlook, although more cautious than last year’s survey,” Dharmasthira added.

Software is expected to represent the second-largest portion of the IT budget in most countries, with the exception of India where software and hardware spends are roughly equal, and Australia. In Australia the spending is notably higher on IT staff. India is the most aggressive with the highest software budget allocation (26.9 per cent), followed by Singapore (25.8 per cent), Malaysia (24.1 per cent) and China (23.1 per cent), it added.

Wipro Launches w-SaaS for Software Companies

In a move aimed at expanding its cloud computing service offerings,, Wipro announced the launch of w-SaaS which will enable software firms to offer their applications in a multi-tenant model.

The service runs on Oracle’s computing technologies, which includes Oracle databases, middleware, and virtualization software. Wipro says that the adoption of such a model by the enterprise segment will result in cost savings of around 10-20 %.

"We are delighted to team with Wipro to provide SaaS solutions," said John Gawkowski, VP of platform technology solutions at Oracle, in a statement. The partnership will "help our joint ISV customer base in their adoption of SaaS," he said.

We are a USA based organization, looking for qualified and experienced service provider to assist in the development of an Education Data Store and Decision Support System. We have collected data of approximately 200000 students and 40000 staff employed by the school units and we would like to have a web-based, secure, centralized, longitudinal data store that will serve as a source for research and longitudinal data analysis; provide a decision support system with analysis and reporting tools for use by a wide range; etc. Our Estimated budget for this work is 1000000 dollars.
Scope of Services:
  1. Technical & Software Requirements: Web-based centralized enterprise database, must integrate with our MS SQL Server database, accommodate users with a minimum 56kBps-based Internet connection, provide the ability to store all associated attachments (multiple file formats) in the central database, and make them accessible through the application, provide the ability to import and export data from various systems, shall be scalable, hardware independent and support cross platform application operations, etc.
  2. Security Requirements:
    a) Security: Provide the ability to timeout a user's screen with automatic timer for security, capability of mass security updates, provide encryption, ability to do mass updates to groups of users as needed, Use a consistent security model throughout, etc.
    b) Logging and Access Rights: Provide the capability to log into the system with user name and password, mask the password with asterisks, capability to limit the number of log on failed attempts to 3 and directing user to page indicating log on failed, etc.
    c) Managing Security and Access: Provide the capability to add, change, or delete roles, provide the ability to maintain an audit trail of transactions made in the system. Both a before and after image of data changes shall be captured in order to record the specific data elements that were modified; etc.
  3. Data Extraction, Transformation, and Load (ETL) and Integration Requirements: The System shall provide the capability to Extract, Transform, and Load (ETL) into the System database and ability to integrate with our sources and with new data sources.
  4. Data Warehouse Requirements: Provide data warehouse optimization tools, provide performance monitoring tools, provide a data management plan that includes storage and archiving strategies, provide the capacity to store twenty (20) years of data.
  5. Data Analysis, Access, Queries and Reports (General Data Analysis, Access, Queries, and Reporting Requirements): Provide the ability for users to perform data analysis and reporting.
  6. Data Exporting and Interface Requirements: Provide the ability to export data in a variety of standard formats (e.g., xls, csv, xml, txt, rtf, pdf) that can be integrated with other data systems and shall be able to import and export data to and from third party software.

Software Exports to Grow In Double Digits

Chandigarh: India is expected to clock double-digit growth in the software and IT enabled services (ITeS) exports next year as the U.S. and other markets are recovering from the meltdown, a top official of the trade association NASSCOM said here Thursday.

"We are expecting IT exports to grow in double digits as the software markets of the US and other countries are recovering well. These markets became sluggish due to the financial meltdown but now things have started improving," NASSCOM chairman Pramod Bhasin told reporters.

He was speaking on the sidelines of 'e-Revolution 2009', a flagship forum of this region jointly hosted by the governments of Haryana and Punjab and the Chandigarh administration in association with NASSCOM and Software Technology Parks of India (STPI).

"In 2009-10, the Indian market has grown by merely four to seven percent and the software exports from India have been around $48 to 50 billion. Whereas in 2008-09, it increased at 16 percent and was at $46.3 billion," said Bhasin, who is also the chief executive officer of Genpact.

Emphasising on improving skill-sets the work force, Bhasin added: "At present the IT industry can employ only eight to 10 percent of the total graduates due to their lack of required skills. There is a need for an updated curriculum and industrial training to hone the entrepreneurial skills and talent of our youngsters."
